1. Agreement to Terms

By installing or using Lumina: AI Image SEO ("the App," "our App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not install or use the App.

These Terms apply to all users of the App, including merchants who install the App on their Shopify store.

2. Description of Service

Lumina: AI Image SEO is a Shopify application that uses artificial intelligence to automatically generate alt text (alternative text) for product images. The service helps improve your store's accessibility and search engine optimization (SEO).

Our services include:

  • AI-powered alt text generation for product images
  • Bulk processing of multiple images
  • Auto-Pilot feature for automatic optimization of new products
  • History tracking and revert functionality
  • Customizable AI settings (tone, brand name, language)

3. Account and Installation

To use the App, you must have a valid Shopify store and install the App through the Shopify App Store or direct installation link.

By installing the App, you authorize us to access certain store data as required to provide the service, including product information and images.

4. Subscription Plans and Billing

4.1 Available Plans

We offer the following subscription plans:

  • Free: 10 credits per month
  • Basic ($9.99/month): 100 credits per month
  • Pro ($29.99/month): 300 credits per month + Auto-Pilot
  • Unlimited ($49.99/month): 5,000 credits per month + Auto-Pilot

4.2 Credits

One credit equals one image optimization. Credits reset at the beginning of each billing cycle. Unused credits do not roll over to the next month.

4.3 Billing

All billing is processed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge your payment method on file. All paid plans include a 7-day free trial.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the service until the end of your current billing period.

5. Fair Use Policy

The "Unlimited" plan provides 5,000 credits per month, which is designed to accommodate high-volume stores. This plan is intended for legitimate business use only.

We reserve the right to:

  • Monitor usage patterns to prevent abuse
  • Suspend or terminate accounts that demonstrate abusive or fraudulent behavior
  • Limit service to accounts that exceed reasonable usage thresholds
  • Contact users whose usage significantly exceeds normal patterns

Examples of prohibited usage include automated scripts designed to exhaust credits, reselling the service, or using the service for stores you do not own or operate.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App or servers
  • Upload images containing illegal, harmful, or offensive content
  • Share your account credentials with others
  • Use automated tools to access the service beyond normal usage

7. Intellectual Property

The App, including its design, features, and content, is owned by us and protected by intellectual property laws. You retain ownership of your store data and product content.

The alt text generated by our AI becomes part of your store content, and you may use it freely for your business purposes.

8. Service Availability

We strive to maintain high availability of our service. However, we do not guarantee uninterrupted access and may experience downtime for maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE QUALITY OF THE AI-GENERATED ALT TEXT MAY VARY, AND WE DO NOT GUARANTEE SPECIFIC SEO RESULTS OR ACCESSIBILITY COMPLIANCE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

12. Third-Party Services

Our App relies on third-party services, including OpenAI for AI processing and Shopify for platform integration. Your use of these services is subject to their respective terms and policies.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or sending an email. Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your use of the App at any time by uninstalling it from your Shopify store.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
